So if we do see an appeal, we will break new ground (and/or ice). The Hearing: Who Was There? The hearing was held at the law firm Proskauer Rose LLP. Thats the firm that acted for the NHL during the lockout. Very good law firm. Apart from Thornton appearing at the hearing, his agent Anton Thun, NHLPA representatives Roman Stoykewych, David Sinclair and Maria Dennis, and Boston General Manager Peter Chiarelli were all in attendance. Thun and Chiarelli were called by the Union to testify. On the NHL side were members of the League office, including Deputy Commissioner Bill Daly, David Zimmerman, Julie Grand and Brendan Shanahan (who was called to testify), as well as Joseph Baumgarten from Proskauer Rose. While Thornton has an agent, the NHLPA handles the hearing. The agent can help with arguments, but ultimately the Union is in charge of the appeal and does the talking. NHLPA: What They Argued The NHLPA did not dispute that a suspension was warranted, but rather argued that the suspension was too long. So the NHLPA focused on length and not whether a wrong was committed. In fact, at the hearing, the NHLPA and Thornton acknowledged that the act was "quite serious", "harmful", and resulted in "significant" injury. Bettman writes that the NHLPA was aiming for a suspension closer to 10 to 12 games. In doing so, the Union relied on the leagues past practice for similar incidents, Thorntons clean record and the act lacking premeditation. Overall, the NHLPA argued that the "punishment was excessive." Bettman Disagrees In preserving the length of the suspension, Bettman relied heavily on the intentional nature of the act together with its "highly dangerous nature" and the "extent of the injury." As per the NHL CBA, the league considers a number of factors when determining the length of a suspension, including the following: (1) the excessive and unnecessary nature of the act, (2) the injury sustained, (3) whether the player has a rap sheet or is a repeat offender, and (4) the circumstances of the game. The league can also consider any other relevant surrounding circumstances. Bettman ruled that Thornton engaged in intentionally excessive force. He skated the length of the ice, slew footed Orpik, dragged him to the ice from behind and punched him multiple times in the face. Orpik, Bettman writes, "never had a chance to fairly confront his opponent, much less an opportunity to defend himself.. Barry Sanders Jersey. " As well, Orpiks injury was also key in maintaining the suspension. Bettman noted that there was still no "definitive date for his return" and that there is "uncertainty as to his future condition." Bettman also ruled that the act constituted "retribution" for Orpik declining Thorntons invitation to fight after Orpiks hit on Louis Eriksson. For the Commissioner, that also supported upholding the suspension. The fact that Thornton had no prior history of suspensions was recognized by Bettman. Indeed, the Commissioner expressed that it was "certainly possible" to argue for a more "severe punishment." So it looks like Thorntons clean record may have resulted in a shorter suspension. Bettman also relied on one more key factor: the human brain. It is recognized that players may suffer irreversible brain damage as a result of blows to the head. Consequently, the league must take active and decisive steps to safeguard the brains of its players. That includes imposing punishments that are designed to strongly discourage behavior that threatens the long-term health of its players. The league would argue that failing to firmly discipline players puts all players at risk. Hockey is an inherently dangerous sport and that will never change. Still, contact that is not part of the game will be scrutinized. Indeed, the 200 plus NFL concussion lawsuits, the NHL class action concussion lawsuit and the Derek Boogaard lawsuit weighed heavily on the decision making process. The league simply cannot be seen as soft on brain damage with this mass of litigation gathering around sports. So the legal side of this case was inescapably important. Some have argued that the nature of Thorntons act just doesnt match up with past lengthy suspensions because Thornton used his glove to punish Orpik rather than his stick or skate. This type of argument is a red herring and ignores the bigger issue at play: its not how the harm is delivered but rather what harm is inflicted. Times have changed and penalties must be aligned with evolving sensibilities. Indeed, Bettman wrote in his Decision that a player "who today blatantly flouts the rules in a manner that causes a head injury can and should expect to be severely disciplined." Why So Long For Bettman Decision? Thorntons hearing was on December 20. So it took 4 days for the Commissioner to issue his decision. In part, a reason for the delay was that the NHL wanted to get the decision just right given the possibility the case could be appealed to an independent arbitrator. The NHL wanted to make sure, in part, that its reasons were well-reasoned, considered and thoughtful. So Whats The Takeway? The extent of the harm delivered together with the weight of the concussion lawsuits and evolving sensibilities conspired to preserve Thorntons suspension. Bettmans decision was not only predictable, but it was also prudent and ultimately correct. As he rehabbed that injury, Holmes decided it was time to go under the knife, again. This time, Holmes was going to have his troublesome left elbow fixed. Why not? He wasnt fully ready to come back to the tour anyway. Once the calendar changed to 2014, Holmes was ready to go. He waited until late January at the Farmers Insurance Open to make his debut. It has been a slow build to fully get back into game shape. He had more finishes outside the top 50 -- five -- than he had inside the top 20 -- four. However, all four of those top-20 finishes came in his last five starts before the Wells Fargo Championship. Entering the Wells Fargo, Holmes had shot par or better in 14 or his last 20 rounds, and that trend continued at Quail Hollow. Holmes shot 2-under 70 in the opening round, then went 11-under par in the middle two rounds to take the lead entering the final round. Coming down the stretch, he led by two and made the finish interesting. Jim Furyk sat two strokes back and had been in the clubhouse for nearly two hours. He started to pack his things while Holmes was on 18, but stopped when Holmes hit a poor chip shot. Needing to get down in two putts for the win, Holmes did just that to close out a 1-under 71. The win was his third on the PGA Tour. Among the biggest aspects of the victory for Holmes is that he now qualifies for all four majors. When he tees it up at Pinehurst for the U.S. Open next month, it will mark his first start in a major since that 2011 PGA Championship, which he had to withdraw from.     • VANCOUVER - After a short break during the group stages of the World Cup, the Major League Soccer season gets back underway on Wednesday night with an all-Canadian clash at BC Place as Vancouver Whitecaps host Montreal Impact (live on TSN and TSN 690 at 9:30pm et/6:30pm pt). Padres Eric Lauer Jersey . The Whitecaps will look to pick up where they left off and cement a place in the Western Conference playoff places, while Montreal will be hoping for a much different story after an extremely disappointing start to the MLS season. Winning the Canadian Championship was the bright spot so far this year for an Impact team that sits bottom of the Eastern Conference. The Form: The Whitecaps enter the match unbeaten in their last seven matches (Won 3, Tied 4) while the Impact have won just twice all season and have only picked up two points from their previous six matches on the road. Vancouver needed a late penalty from Pedro Morales to rescue a point at Philadelphia in their last match, despite leading the game 2-0 at PPL Park. The Whitecaps have been having no trouble scoring goals, but will need to tighten up defensively if they are to build on their excellent start to the year. The Caps havent lost in MLS since April 12 when they were beaten 1-0 by LA Galaxy in California. Vancouver are unbeaten against Eastern Conference opposition so far this season. After beating Toronto FC to be crowned Canadian champions, and winning at home to high flying New England, Montreals revival came to a crashing halt with a 4-2 loss at home to DC United two weeks ago. Things have improved for the Impact since they started the season by taking just three points from a possible 21 through their first seven matches, but they will need to be consistently strong between now and the end of the year if they are to have any chance of getting into the playoff race. The Impact are currently eight points outside the playoff places. With only 13 goals in 13 matches, the Impact are the lowest scoring team in MLS, but the signing of Jack McInerney has proved to be an excellent addition. The Big Question: Will Montreals defence be able to cope with Vancouvers speedsters? The Whitecaps have caused plenty of problems for their opponents this year with lots of attacking options, and Chilean midfielder Pedro Morales proving to be the perfect set-up man. Striker Erik Hurtado has been leading the way in recent games with five goals in his last five matches in all competitions. Hurtado has shown the ability to cause defenders all kinds of problems with his strength and speed, and the Whitecaps can also call upon the pace of Kekuta Manneh and Darren Mattocks. In their last match before the break, Montreal defended poorly and conceded four goals at home to DC United, however, in their previous game, they managed to keep a clean sheet against a strong New England team. If the Impact defence isnt switched on from minute one, the Whitecaps young guns could take advantage. Montreal coach Frank Klopas has the chance to make changes in defence if he chooses, with the recent additions of Futty Danso from Portland, and former Sporting KC man Mechack Jerome. The Lineup: There are a few decisions for Whitecaps coach Carl Robinson to make with regards to his starting lineup. Captain Jay DeMerit came off injured in the tie at Philadelphia and is sidelined for six weeks. Robinson will choose from Andy OBrien, Carlyle Mitchell, Johnny Leveron and Christian Dean to fill the two central defensive places. At the other end of the pitch, it is possible the Caps could start with Mattocks and Manneh supporting Hurtado. Robinson has said he would love to see the three players start together at some stage and it is possible that this could be the occasion to try it. If not, one of the Whitecaps two Uruguayans, Sebastien Fernandez or Nicolas Mezquida, could get the start. With Marco Di Vaio and Justin Mapp expected to miss the match through injury, the Impact will be relying on McInerney and Andres Romero to provide a goal scoring edge. Both players have been in good form of late. McInerney has four goals in eight MLS appearances since joining the Impact from Philadelphia, and Romero had scored in his last three MLS matches. The most interesting decision for Montreal will be who Klopas decides to play in defence, and whether or not either Danso or Jerome will be handed an Impact debut. In midfield, Klopas could give a debut to 30-year-old Spaniard Gorka Larrea who played 90 minutes in the reserves against Harrisburg City Islanders last Friday. The Odds: This is only the third meeting between the two sides in Major League Soccer, with the Whitecaps having won both of the previous encounters. He struggled with arm injuries and had surgery over his final two campaigns with the Cardinals, throwing his most recent major league pitch on July 9, 2008. Mulder had been working as a television analyst and was trying to make a comeback after retooling his delivery. He sounded optimistic that he would make the team when pitchers and catchers reported on Friday. "Ive worked hard and what Im doing right now is good," Mulder said. "I know its working and Im excited for the opportunity." Now, a career that was derailed by two shoulder operations could be finished for good after this injury. Mulders best season was his second in 2001, when he went 21-8 with a 3.45 ERA while anchoring a dominant rotation with Barry Zito and Tim Hudson. Francis will preach patience, soundly supported by not having his top two centres, a crippling blow for any NHL club. The longer Carolina waits to make a significant deal, the more money that is paid down in salaries, which may not be budget friendly, but could lure a larger collection of bidders - including cap-strapped contenders - if a key piece like Staal is legitimately in play. What we know at this point is; Staal is not going to be the one to come out and say he wants out. What Rebuild? The Calgary Flames remain in rebuild mode, strongly interested in making deals for age appropriate assets and are keenly motivated to strengthen the organization through the draft and development. Toronto FC entered the World Cup break with a combative 1-0 win over the San Jose Earthquakes on Saturday, upping their record to 6-4-1.  There is nothing cosmic about Toronto FCs newfound positive fortunes.  The recipe has been simple: commitment to defensive workrate, sound team structure with a true game-breaker in front of goal.  Its been that cliché, yet poignant never-say-die kind of stuff.  Just how the team wants it. The first half Saturday was arguably the best 45 minutes played on the season.  Toronto FC went toe-to-toe with San Joses physical play.  The movement, the use of space, the passing and shape were prominent, but it was team commitment standing out the most:  50/50 battles.  Getting stuck in.  Getting forward and pushing onwards.  The simple stuff.  A winning attitude is being developed and dedication to the crest has never stood out so much.  We sometimes focus too much on tactics, formations and Xs and Os.  There are many reasons teams win or lose.  Its oftentimes the basic intangibles that first need to be established before the more complicated follow. Thus far, the basics have been the difference between points and no points.  This is the first step and its a big one. The bar will continue to be raised.  Team approach will be tested.  It will be up to the manager and individual quality to take this team from being good to potentially great.  The appetite lived up to standing.  The main course begins post-World Cup. Here are my five thoughts on Toronto FC at the World Cup break: 1. Trader Tim – General manager Tim Bezbatchenko has been a busy man in his first eight-plus months on the job.  An off-season overhaul was required and mission accomplished, but it was evident the team was still a work in progress to start the year.  Too thin at some positions and too weak at others.  The ensuing in-season adjustments have followed and have come with purpose and all look to be solid moves.  Gale Agbossoumonde, Issey-Nakajima-Farran, Alvaro Rey and allocation money go out, with Luke Moore, Collen Warner and Dominic Oduro coming in.  With the acquired players come great salary, but more substance.  These are all considerable moves and represent potential starters in exchange for players either battling for roles or ones who have fallen out of favour.  Moore has two goals in four games and has paired well with Jermain Defoe up front.  He holds up the ball and is a supplementary goal-scoring threat that was desperately needed.  Warner filled a significant gap at defensive midfield.  It is clear head coach Ryan Nelsen prefers a diamond in the midfield, with a central player sitting on top of the back four.  Warner is the man tasked with the job and his true importance will come to light once Michael Bradley returns from the World Cup.  He deservedly won Man of the Match Saturday, rarely out of position and confident on the ball.  Oduro has just arrived, but adds more pace to an already dangerous counter-attack.  Hes a proven MLS commodity and a useful player, adaptable to play either up front or wide right, particularly in a 4-3-3 if required.  It may be early, but from the outset all three trades seem like a win for Bezbatchenko.  The rookie GM deserves significant credit for these moves in addition to off-season trades for Jackson and always-impressive Justin Morrow.  Bez knows the league and has massively upgraded the depth of the roster.  No ego.  No meddling agents.  Just business.  This Tim deserves credit. 2. Big money, big results – Defoe with seven goals in eight games.  Check.  Michael Bradley as on-field general, influential leader with a game-winning goal under his belt, looking to be among the top players already in MLS.  Check.  You get what you pay for.  The early returns reinforce Toronto purchased absolute quality.  No player may ever justify a $7 million per year salary in MLS, not even David Beckham, but if youre trying to reach for the stars, then get there.  Any misplaced cynicism about either signing is gone.  These two make Toronto FC an instant MLS Cup threat, no question.  The waiting game on the third Designated Player, Gilberto, continues.  He has more games missed through injury (two) than goals scored (none).  Its been a tough transition for the Brazilian: new city, new country, new language and new life.  Never mind the fact hes playing in a new league and with new expectations.  Flat-out, Gilberto has been disappointing, but weve seen flashes.  The hope is the flashes turn into moments that turn into games.  One has to wonder how much patience will be given.  DP spots are gold, especially for a club like Toronto FC that can pay for quality.  3. Points earned – It cannot be said the team has hit absolute stride.  It has been ugly at times with Toronto FC grinding out results.  They have only out-possessed opponents twice on the season and more consistent build-up is essential.  Distribution needs work, as does movement off the ball.  The learning curve has been made more difficult through injury in the team and a wonky schedule.  Chalk up an early season 3-0 loss at Real Salt Lake in the ugly category, while a 2-1 home loss to New England disappointing.  Other than that, a difficult schedule has played out favourably and late goals have come, more often scored than conceded.  Late tallies against Columbus (twice), New York, and Sporting Kansas City have either won or secured points.  Its these kinds of performances that bode well long term.  Its characteristic of winning teams to win while not at their best.  Progress. 4. Nellies team – We are witnessing the maturation of a head coach.  Nelsen was in a difficult position last year, coming straight off the field as player, late into the fray, into a completely new context as a first-time coach with a subpar team.  It was as tough an introduction to coaching as one can imagine.  Nelsen survived the off-season purge and was given requisite tools to succeed for his sophomore adventure.  He may still have critics, but patience is needed.  Week by week, Nelsens in-game management has grown.  His substitution patterns have been spot-on and his read for the game is becoming more apparent.  It was a calculated gamble by the previous regime to hand over the reigns to a man with no experience, but a natural leader and well liked within the game.  Its paying off.  Nelsen was essential to the recruitment of the likes of Defoe, Julio Cesar, Steven Caldwell and Bradley Orr.  And its no secret his players love to play for him.  Nelsen doesnt apologize for his team, but he sticks up for them, stands by them and doesnt throw any player under the bus.  The culture created is a positive one and the benefits are being reaped.  5. Areas for Improvement – It must be kept in mind the team is still a work in progress and there are clear areas in need of improvement and/or upgrades.  Deficiencies in ball possession and passing have already been documented, as have the struggles of Gilberto.  Doneil Henry needs to find stability in his game with more consistent one-v-one defending, decision-making and positioning.  With Henry, its worth having patience, as he is a budding stud centre-back.  Improvement on the wings is also required.  This may come through trade or transfer.  The team often plays too narrowly with Jonathan Osorio more comfortable playing inside than on the left side.  Tactically, after early season relentless high pressure, the team has become too comfortable sitting too far back in defence.  There needs to be a balance here, and it hasnt been found yet.  Most importantly for TFC, they must get Defoe the ball.  It needs to be much better and more frequent.  Defoes been relegated to being too much of a chaser.  Service at his feet is mandatory to ultimately get the most out of their prized striker. Toronto FC is off until a June 27th trip to New York to take on the Red Bulls (4-5-6).  Reds Reggie Sanders Jersey . Stephen Weiss posted a goal and two assists, Drew Miller scored a short-handed goal, Henrik Zetterberg also lit the lamp and Petr Mrazek made 37 saves in the Red Wings sixth straight win. Aleksander Barkov finished with a goal and two assists, Nick Bjugstad supplied a goal and a helper and Brad Boyes and Brandon Pirri also scored for the Panthers, who dropped their fifth game in a row. Al Montoya made 10 saves in relief of Roberto Luongo, who gave up five goals on 17 shots. After Glendening increased Detroits lead to 5-2 with a wrister in front with 8:41 left in the second, Bjugstad sent a shot over the shoulder of Mrazek from the left side of the net four minutes later. The Panthers got within a goal with 9:06 to play after Boyes tapped in Barkovs crisp pass from the left circle. Florida went on the power play with 2:32 remaining after Drew Miller was called for interference and pulled Montoya for a two-man advantage. Mrazek, however, fought off the Panthers barrage for the win. On the penalty kill early in the game,, Miller took Jonathan Ericssons bank pass off the boards in the neutral zone, skated in on a breakaway and backhanded the puck through Luongos pads to start the scoring 8:06 into the contest. Reds Joe Morgan Jersey. The Panthers went ahead with two quick two power-play goals. Barkov finished off a tic-tac-toe passing play with a wrister from the right side of the net during a 5-on-3 at 9:08 and Pirris slap shot trickled through the pads of Mrazek just 68 seconds later for a 2-1 lead. Early in the second, Gustav Nyquist took Luongos failed clear behind the net and sent a pass toward the slot. Justin Abdelkader tipped it to Zetterberg, who made it a 2-2 game on a wrist shot 32 seconds into the middle stanza. Detroit took a 4-2 lead with two quick goals. Glendening took the rebound of Weiss stuff attempt in front and lifted the puck over Luongo at 7:07 of the second and 1:19 later, Weiss tapped in Riley Sheahans cross-crease pass. Game Notes Sheahan tallied two assists ... Zetterberg has five goals and four assists during a four-game point streak ...
